About the role

The Office of the Solicitor acts as litigation counsel for the USPTO on intellectual property law matters and also works in collaboration with the Department of Commerce on interagency intellectual property law matters.

The incumbent will have opportunities to brief and argue cases before the U.S. Court of Appeals for the Federal Circuit, as well as manage and participate in litigation in other federal courts. The work is challenging, and the atmosphere is professional and collegial.

  • You thrive providing legal and policy advice to senior management and other offices within the Agency on trademark, copyright, ethics and disciplinary matters, including rulemaking, procedures, and proposed legislation.
  • You are confident handling trademark clearance and enforcement matters.
  • You are eager to assist the Deputy General Counsel and the Director of the Office of Enrollment and Discipline in prosecuting practitioners charged with misconduct before an Administrative Judge (and, if necessary, defending those decisions in federal court).
  • As a condition of employment for accepting this position, you will be serving in a position in Schedule Policy/Career of the excepted service.

  • Merit Systems Protection Board (MSPB) appeals of adverse actions concerning performance, discipline, and other matters arising under chapters 23, 43, and 75 of title 5, U.S.C will not be available to an individual serving in this position.
  • Prohibitions on prohibited personnel practices will be enforced by the Office of General Counsel [or agency equivalent position] and not the Office of Special Counsel.

Education

You must possess a Juris Doctor (J.D.) degree or Master of Laws (L.L.M) degree from an American Bar Association accredited law school and an active member of the Bar in Good Standing of any State, District of Columbia, Puerto Rico, or any Territorial Court under the U.S. Constitution.

If this position requires proof of higher education, or you are substituting education for experience, you must submit an unofficial transcript or a list of courses that includes the following information: name of accredited institution, grades earned, completion dates, and quarter and semester hours earned.

Education completed in foreign colleges or universities may be used to meet the requirements. Please refer to General Schedule Qualification Policies for more information. You are not required to submit official documents at this time; copies are sufficient.

Special Instructions for Foreign Education: Qualifying education from colleges and universities in foreign countries must be evaluated in terms of equivalency to that acquired in U.S. colleges and universities.

Applicants educated in whole or in part in foreign countries must submit sufficient evidence, including transcripts, to an accredited private organization for an equivalency evaluation of course work and degree. A listing of these accredited organizations can be found on the Department of Education's website - US Department of Education.

You must provide a copy of the letter containing the results of the equivalency evaluation with a course by course listing along with your application.
